- Deceased was working during the back shift in the East Bank district of the Stone Coal seam, 2 feet 3 inches thick, where some old pillars were being taken out on the longwall system. He was engaged on the right side of a gateway when a stone fell upon him from the roof close to the face, canting out two props in its fall. It measured 1 feet by 4 feet, and was 18 inches to 22 inches
thick. It was relieved by a parting above, a slip next the face, and two jacks at right angles to each other. Deceased's father was deputy in the district during the fore shift, and he had examined the place before work started, and at 8am, when the fore shift hewers were in, but as they had not worked at the point where the stone fell, deceased began to work just as his father had left it. There ‘Find that it has been the result of a pure accident.’
