- A drift about 5 feet wide and 9 feet high had been driven for a distance of about 12 feet from the surface out of the bottom of an old subsidence; the ground was clay and iron ore mixed at the entrance a big stone projected into the drift at the left hand top corner and formed part of both side and roof. On the day of the accident some clay and iron ore had been taken out near the big stone causing it to look dangerous, and a prop was set under it, but as it was too long to be properly driven up it was taken Out again to lower the footing and almost immediately part of the big stone, measuring 3 feet by 2 feet by 2 feet, relieved by a clayey back, fell and caught deceased as he was going for a pick. The overman had visited the place twice during the course of the shift and had sounded the big stone and thought it safe.
