He was regulating the wet smudge coming through the opening at the bottom of the hopper on to the creeper. The hopper, which was 20 feet deep and contained about 40 tons of smudge, became clogged, and he went to the top to push the smudge down, and fell in the hopper and was suffocated. The hopper was properly fenced and it was against the rules for him to go to the top alone.
