He was filling a waggon in a broken place where the seam was 17 feet thick when a piece of stone burst from near the top of the seam and striking him on the head killed him. A shot had been fired about 1.5 hours before immediately under the stone which fell. The shot knocked out a prop which the deputy had wisely set on the face side of a well defined back crossing the place. This prop was not reset. Probably the roof had settled at the back owing to the failure to reset the prop and this caused the side to burst out.
