- An old road which had been standing for many years was being reopened. The road had arched itself, and one side an open break ran in the coal parallel with the road. Deceased had tried to pull with his pick part of this rate of coal, but failing to do so continued to dress off sufficient to enable him to get a setting of timber in. Suddenly a portion of the rate broke off and knocked deceased down. He fell on his back across the rails, and sustained a fractured dislocation of the spine, from which he died too days later. The rate should have been got off with a bar.
