Deceased was employed as brakesman at the top of a brake incline 40 fathoms in length and having an inclination of 73 deg. The brake lever was situated at the uppermost bench, the formation of which had not been completed. It was not part of deceased's duty to place the tubs on the carriage but it appeared that he had attempted to do so probably to assist the miner who was a relative. He forgot that the carriage was not at the bench pushed the loaded tub into the incline and fell with it to the bottom.
