- Deceased and another man were driving a 4 yards wide skirting alongside a fallen headway in a seam 3 feet 6 inches thick. They met a 15 inch dip fault, and unknowingly had passed under a slip running through the 15 inch thick panel of shale overlying the coal. An area of this roof stone next to the old headway fell, 7 feet by 4 feet 6 inches carrying out four props end killing Watson. This stone was divided into three pieces by breaks parallel to the old headways, and it is likely they were there before the coal was removed. Assuming the props were properly set, deceased seems to have exercised reasonable care.
