A flat itself end the road outbye dipped to the shaft 2 inches per yard. There were spring chocks on the empty way and a block chock of which only one part was moveable to put across one rail of the full way. Twelve full tubs were in the fiat with 18 drags in the wheels of the first nine. The flatter had taken out the drags of the last three and had forgotten to put them in again. Three drivers of which deceased was the last went away with three tubs each and another driver was ready to take away the last three but the gears of his pony required adjusting and the flatter was helping him to do this when another pony came outbye and its limbers caught the remaining three tubs and they moved away and could not be stopped although the flatter tried to put in drags and the wagonwayman who was near ran after them and tried to throw them off the way. They ran 130 yards and collided with deceased's set and he was found dead under the first of the runaways having probably been riding on the last tub of his set. The chock was not used. The Jury did not attribute blame to anyone. The Local Inspectors in their report said 'we find the cause of the accident due to the tubs left standing without any drags in the flatter having taken them out also neglected to put the chock in position.'
