- He was engaged in drawing timber in a return airway and had set temporary supports under the planks to be withdrawn in a proper manner. Several pairs of gears had been safely withdrawn, and deceased had cut the heads of both end props under another plank and attempted to knock out one prop with a plank, but did not succeed. He was proceeding to cut the head of the prop again when the timber collapsed, a large stone above falling on to him. If a proper safety appliance had been used, as it should, he would have succeeded in drawing the prop at the first attempt and the accident would not have occurred.
