- Deceased was driving three full tubs along a stall road dipping 1 in 24, the second and third tubs each having one wheel lockered, when a large piece of coal on the first tub, which was filled 15 ins. above the tub, caught against the side and fastened same. After telling another driver his tubs were fast, he returned, found a roadman’s dresser, and standing in front of the tubs, with this appears to have liberated them. There was a brow, under which was a bar, immediately behind him, and before he had time to clear himself the tubs started and his head was crushed between the coal and this bar, his skull being fractured and neck broken. He was in this position with the dresser in his hand. Deceased ought to have sought the roadman to assist him with the tubs, but evidently thought he could manage alone.
