The deputy had 2 shots to fire in deceased's working place, which was 8 feet wide. After firing the first shot and coupling up the second, deceased remembered that he had left his explosive canister in the face, and obtained permission to get it. Whilst deceased was away a hewer from an adjoining place came out for his bait and sat near the deputy, who took it for granted that this man was deceased, but did not identify him at the time. He fired the shot, which caused injuries to deceased which terminated fatally two days later.
