- A set of 46 loaded chaldron wagons ran by gravity to the staiths drawing the rope after them by means of which the empty wagons are taken back. The first 16 wagons were from Heworth Colliery (which also uses the railway) and the last 30 from Ouston Collieries. The set was moving slowly and the wagon sorter dropped the brakes on the 10 first of the Heworth wagons so as to check their speed and allow him to uncouple them from the Ouston wagons. Deceased appears to have been in the act of applying his weight to the lever of the brake on the eighth wagon when he fell across the rail and 13 or 14 of the wagons passed over his body. This accident happened near the staiths of the Tyne at the termination of a private railway from the colliery which is owned and worked by the Colliery Co. The staiths are not on ground under which the Company any mineral rights and are seven miles from their nearest colliery.
