- Deceased was bringing an empty waggon down to the screens when another bumped into it from behind. He was knocked down and one leg slipped beneath the wheels. The injury was so severe that he died on the same day. Three waggons had originally been moved, and two of them were left 12 yards behind the screens. A shunter ran three more waggons into the two, which caused them to be moved rapidly on to the one in Upton's charge. It was careless of Upton not to securely brake the two waggons, and also of the shunter not to see them securely braked before allowing others to bump them.
