- Deceased and another were engaged unloading coal from a truck on to a wharf. They wished to move the truck and deceased got in front of it, on the side next to the wharf, to attend to the brake. The truck was moved forward by the other man by means of a crow bar, and deceased was caught between the truck and the side of the wharf, and so badly crushed that he died shortly after being extricated. The railway dips less than one quarter of an inch per yard in the direction in which the truck was being moved. The space between the wharf and the nearest part of the truck was 6.5 inches. The truck had a brake-lever on one side only, and this side was next to the wharf with the handle of the lever at the front end. There would seem to have been no reason why the brake need have been used at all; wood "scotches" would have served the purpose better in the circumstances.
