- Deceased was engaged in driving one of a pair of crutts from the Red Mine to the Red Shagg Ironstone. The crutts were 22 yards apart, the main one being 25 yards in, and the back crutt, in which deceased worked, 21 yards in from the level in the Red Mine. Deceased prepared three shots and sent his mate to warn the men in the other crutt. The latter did as directed, and on returning told deceased a shot was also being lighted in the other crutt. Deceased then lighted one of his shots and came out of the crutt with his mate. Deceased then went along the level, His mate went through a door to a dip in the Red Mine, the men from the other crutt at the same time guarding the approach to the crutts from the opposite direction along the level. Deceased’s mate heard a report almost as soon as he got through the door, and declared that he knew it was the shot in the main crutt. He waited for a second report and on his return to the back crutt heard cries for help from deceased, who had evidently gone back on the assumption that the first explosion was that of his own shot.
