Deceased was struck on the head by a piece of stone, about 36lbs. in weight, which fell from the side of a small staple pit, which was being sunk from the 6 feet to the 9 feet seams. The pit was 9 feet in diameter, was walled for 11 yards, and unwalled for the remaining 16. The shaft sides had been examined by an overman shortly before the accident, and deceased himself had also pulled down such loose stones as he found.
