The deceased was passing along the main road to his work and when under a portion, where the top was being ripped and side taken off, about 200 yards from the face, a piece of stone fell without warning and killed him. A shot had been fired in the roof about eleven hours before and this had no doubt shaken the stone. A deputy had examined the road between the shot being fired and the accident occurring, and reported it to be safe.
