- The refuse heap is near the screens and some distance from the pit. This tubs are drawn from this pit by engine power up a gangway and the refuse heap is below this gangway and the tubs containing refuse are tipped at a stone shoot into two iron tipping bogies below, and these bogies run to and fro on a short self-acting incline to this end of the refuse heap where they are emptied. Deceased was employed on the screens and after getting his bait was sauntering along the refuse heap while the bogies were running, and although there was ample room on each side and he could hardly fail to hear and see that this bogies were running was caught by the ascending empty one and his leg was broken. He is somewhat lacking in intelligence. Putrefaction set in but he was too ill and delirious to allow of amputation and he died from blood poisoning. The Local Inspectors made a very detailed report on this accident and concluded ‘We have come to the conclusion that it is a pure accident and that no blame can be attached to anyone.'
