Deceased was taking a flitching 4 yards wide along the side of an old cross cut in the Thick coal and setting chocks 6 feet square and 9 feet apart as well as a row of props 4 feet 6 inches apart on the loose side, leaving a 5 feet 6 inch road against the solid coal. While he was getting coal off at the buttock he heard the roof weighting and started to come out. When about 7 yards out he was caught by a fall of patchels 1 foot 6 inches thick which fell from a slip running along by the solid side and which broke off along the edges of the chocks and over the row of props for a distance of 8 yards along the roadway. Nothing fell at the spot where he was working and he would have been quite safe had he remained there. His spine was fractured and he died on Dec. 30th.
