- Deceased and his marrow were engaged drawing timber from an old wagonway in the Bensham or Maudlin seam. They had taken out a running balk and the two props supporting it and had drawn one of the cross balks that had rested on it and were trying to free a second cross balk using a pout to swing it to and fro but were unable to get it clear as it was held by a chock at the end opposite the running balk. Deceased stepped back while his marrow went forward to try and cut it free when a post stone about 6 feet by 8 feet and 7 inches thick fell out between the next two balks upon deceased. The stone was relieved by slips and had jowled drummy but they had not thought it necessary, as would have been prudent, to set a prop under it. They had been visited during the shift by a deputy. The Local Inspectors, reported, ‘it is a pure accident and no blame attached to anybody.'
