Riding out-bye in an empty tub. He and other men had been taking in a new rope for an incline; when they had finished they all got into the tub and signalled to the engineman in the usual way. On reaching the stables while going no more than walking pave the tub got off the way at the points and overturned and threw them all out. Deceased fell on his head in the level and died shortly after being got out. All the men knew it was contrary to the ‘special rules and Smithson had himself been warned not to do so.
