- He and two other colliers were working alongside an airway; the face was 35ft. in width and at an angle of 45 degrees to the airway. The latter had been ripped up to a parting 21ins. above the coal and there was a break parallel to the airway about 23ins. over the coal. The stone to within 7ft. of the face of the place had been taken down up to this break leaving a piece 7ft. long by 1ft. 11ins. wide by 14ins. thick at the end next to the coal and 8.5ins. at the other, under which a prop was set in the middle, but, owing to the coal having being extracted under the heavy end, it suddenly broke off at that end and the prop was displaced and the stone fell on to the deceased and killed him instantly. It was an error of judgement to try and support the stone with timber as it was free on three sides; it should have been taken down as the face advanced.
