- Deceased had been instructed by the fireman to draw a tree and fall some "Slips" coal at the mouth of an opening so as to make it safe for the loaders to work. The tree was just at the edge of the coal, which was "drawn" for some distance over it towards the road side. Deceased and his mates examined the Foot coal roof in the opening beyond the tree, and as it sounded strong, they decided to knock the tree out from that side. As soon as deceased struck the tree with his pick, the slips coal fell, followed by some of the "Foot" coal above him, which latter buried the deceased. He was dead when extracted. The coal came off at slippery facings on two sides of it. There was a "bunter " for knocking out props in the place, but it was alleged that there was not room to use it.
