- Deceased was riding in front of a tram of coal up a gradient of 30 inches per yard. In order to obtain a pull at a higher level than the drawbar, a short chain loop had been hooked to the upper cross-bar, to and the bull chain passed through that. On the journey the ear holding the cross-bar broke, and the bar, swinging round, struck deceased a violent blow behind his ear. He had noticed that the ear of the cross-bar was defective, but had decided to risk it.
