He was holing in a parting between two sections of the seam when the top coal broke over a sprag and injured him so seriously that he died on the 27th January, 1910. The sprags were 5 feet 8 inches apart, or nearer than the prescribed distance of 6 feet, but in view of the fact that a settlement of the strata had recently occurred the distance between the sprags might have been further decreased.
