Deceased was walking up a brow rising 1 in 12, when he was caught by a runaway set of full tubs and crushed between one of them and a roof bar which was 2 feet 7 inches from the rails. At the place where the accident occurred there were brattice screens hung across the road, and deceased would be unable to see the tubs coming. The tubs became unlashed owing to a jerk on the rope when starting.
