Deceased was engaged in getting down some ripping dirt, part of which had been thrown backwards on to some running bars carried on bars let into the side. He was kneeling under a bar when the side gave way letting down one end of the bar. Deceased was struck on the head and his spine fractured and he died or the 18th December. The bar was not broken and was only 3 feet 6 inches long and 3 feet high. For the load which had been put on to it, the bar had not been let sufficiently well into the side.
