Deceased was taking down top coal in a waste in the Yard Seam and for this purpose was cutting out the coal over the head of a prop to permit of its being drawn with a Sylvester A piece of coal weighing about a ton suddenly came away from a slip and fell upon him, fracturing his spine. He succumbed four days later.
