Deceased was driving a horse taking two full tubs inbye, one loaded with stone, which the horse ‘jibbed’ and them started away suddenly and knocked out a temporary roof bar where the road was under repair and deceased was jammed between the tub and the bar. The horse was rather too large to be working in this portion of the road. The roof was constantly settling down, owing to the recent working of the seam above and one below this road and special care and supervision should have been exercised.
