Deceased was taking a full tub from the coal face having hooked his horse to the tub and ordered it to go on the horse ran forward suddenly, tightening the drawing chain and causing the tub to leave the rails. The tub struck out a sprag set under the roof coal, and the latter fell upon deceased, who died from the effects of the injuries on the same day.
