- On his way outbye, the route being by a drift to an upper seam, and then by a drift to the surface, deceased had arrived at the bottom of the drift to the upper seam up which empty tubs are drawn by a rope. A set of 25 tubs was coming to the bottom of the drift at a speed of about three miles per hour and deceased was warned by a rolleywayman who was near of their approach he said he would let them pass but after about 15 tubs had passed he attempted in contravention of the rules to get between two tubs to ride up the drift but fell and was dragged about eight yards and crushed against a brick side wall. The Local Inspectors reported ‘we found everything in order and consider it was just an accident.'
