- Deceased was employed at a motor situated near to the bottom of an engine-plane 840 yards long, and dipping 1 in 2.75 for a distance of 600 yards from the top, the men rode on carriages in the counter dip, but for the remaining distance they were required to travel on foot. Travelling on the engine plane was prohibited, but as it was a better road the deputy permitted deceased to travel on the lower portion of it when the ropes had ceased running for the shift. The haulage on the level at bottom of engine-plane was stopped for a short time owing to a tub having been derailed. The incline rope was also stopped, and the onsetter went inbye about 30 yards to assist in railing the tub. During this interval deceased left his motor and went up the engine-plane. On returning immediately afterwards, the onsetter started the engine ropes, and deceased was caught and run over by the tubs. The accident would not have happened if the rule as to travelling on the engine-plane had been strictly observed. The deputy unwisely relaxed it, in deceased's favour on account of his age.
