- Deceased and his partner tumbled an empty tram on the side of a level piece of road in order to allow the haulier to pass out with the tram of rubbish which they had filled. Deceased stood at the outer end of the tram, between it and the arm of a pair of timber. As the full tram reached the empty, it left the rails probably owing to something which the horse had knocked on the rails, aid caught the corner of the empty tram, driving it against deceased who was badly crushed between it and the arm of the pair of timbers. There was no need for deceased to stand where he did, there being plenty of room on both sides of the road which was free from accumulated rubbish.
