- Deceased was helping his neighbour, a collier named Fletcher, to lower an empty tram to the face of his road, which owing to a fault dipping 12 inches per yard. The full tram had been pulled up from the face by means of a compressed air hauling empty in the meantime having been left in a shunt or parting at the top of the brow. They pulled the empty out of the shunt on to the main road, and deceased was holding it in position for Fletcher to attach a hemp rope, two turns of which were passed round a post, to the outer end of the drawbar, when the tram overpowered deceased, ran down the steep place and reached the face. Undoubtedly it sprag should have been used and an error of judgement was made by both men.
