- After waiting while a loaded self-tipping tram on its upward journey passed by the place where he was standing, 70 feet from the top of and by the side of the sand-tip inclined tramway graded at 1 in 3, he walked across the tramway sod had gone not more than 10 feet when for some unknown reason be returned. Just as he was re-crossing the tramway, the descending empty wagon knocked him down and killed him. He was familiar with the working of the incline, but in a moment of forgetfulness he omitted to look for the position of the tram when making his return journey. His hearing, too, was defective, and was probably farther affected by the ear guards he was wearing to protect his ears from the cold wind.
