- Deceased was sitting in a tub, riding along a level in the Clod Coal seam going to his work first thing in the morning. Workmen were allowed to ride on this length on account of water under foot over a considerable portion of it. Deceased failed to lower his head when the tub in which he was riding reached a spot where the side of the road projected a distance of 9ins. nearly flush over the edge of the tub. He received a blow which dislocated his neck, causing almost instant death. The accident happened in an old shunt or passby. The road on rise side which was higher, was usually used, but at time of accident two loaded tubs stood in it, and the men were taken along the dip-side road.
