- This accident was due to a deliberate breach of General Rule 22 and Special Rule 83. The seam at the place of accident had a section beginning from the roof, as follows:- Coal 7ins., batt 1ft. 6ins., coal 2ft. 2ins., batt 1ft., coal 8ins. Although there was a quantity of the top batt projecting from the face line about 2ft. for a length of 12ft., deceased sat down beneath this and commenced holing in the bottom batt. A portion of the over hanging batt came off at a "slip" and fell upon his back and side causing injuries from which he died three days later. He ought either to have got the batt down or securely spragged it before commencing work.
