Deceased and some others were working at a face of overburden about 9 feet in height. On examining the face, the manager detected a break or soapy head at a certain part of the face, and told the men, including deceased, that they were not to work there. He was called away, and on his return four or five minutes later, he found deceased undercutting with a pick at the place where he had been forbidden to work. He shouted to him to come out of that, but as deceased was coming away, the ground fell and killed him. The manager had repeatedly warned the men not to undercut the overburden.
