- Deceased was controlling the motion of a 10-ton truck loaded with small coal which was moving by gravity down an inclined road at the screens. The screens and roads had only come into use that day in substitution of old arrangements. The motion of the truck was regulated by brakes, one at each end, the end of the levers of which were at opposite sides of the truck; in using the brake it was usual to climb up no the buffer level and stand on the lever. The brake lever at the hinder end of the truck was at the left side, where there was ample room between the truck and legs supporting the screens, but as the attached brake was out of order deceased ran round to the front end or the truck while it was in motion, climbed up at the front end, and stood on the brake lever there and while in this position was crushed between a support part of which was only 8.25 inches clear of the truck.
