- The deceased and another man were opening out an old road which bad been standing for about two years. Above the coal seam there is a parting under a strong grey bind. The intervening stone varies in thickness from 6 to 8ft. and consists of bind, one panel of which has ironstone balls intermixed with it. This stone, owing to the weight on it, during the time the road has been standing, was much broken and had many slips in it parallel to the sides of the road. The seam was originally 4ft. 3ins. in thickness but owing to there being water in the workings, the floor had lifted and was above the top of the seam. Some coal had wasted oft the seam and these two men were sent to fill it up and clear the road. On the day of the accident, they had filled one tub of coal and were taking an empty tub into the place to be filled when a large stone fell from the side at a slip and two breaks, and a smooth parting and caught and killed the deceased instantly. Considering the nature of the stone and that the road had been standing so long, stretchers should have been systematically set.
