Deceased was assisting in turning the bar coal cutter at a gate end, when a roof bar that had been newly re-propped gave way and a piece of roof stone fell and struck deceased on the head forcing it on to a bolt head on the drum and causing a comminuted fracture of the skull. The skid had been rubbing against the prop which was probably the cause of the bar giving way.
