- Deceased received injuries causing his death the same day by his head coming in contact with an iron girder supporting a bridge across a private line of railway. He was acting as waggon rider on some loaded waggons which were being drawn up an incline by means of a stationary engine and rope. The railway is a private line extending from the Pontop district to the point of shipment on the Tyne a distance of about 12 miles. Deceased was employed by Messrs. Bowes & Partners, Ltd. the owners of the Collieries and who own and work the railway. The point where the accident happened was about 5.5 miles from the Collieries and out with any mineral field leased by the Company. Compensation under the Workmen's Compensation Act was claimed by the widow in the County Court. In view of the decision in the Court of Appeal in the case of Turnbull v the Lambton Collieries, Ltd., the claim was not made as for a person employed under the Coal Mines Act but it was argued that the stationary engine was part of a factory. Compensation was refused.
