- Deceased and his mate were taking down stone and making a permanent road 9 feet wide and 7 feet high in a waggonway place in pillar workings in the East district of the Engine or Beaumont seam. Planks with props at each end were put in every 4 feet. A shot had been fired and the stone dressed down, and while deceased held up a plank his mate was putting in a middle prop when a stone weighing 2.5 tons fell from the roof, relieved by a slip at one end, a jack at the side and a good parting above, killing deceased and pinning his mate against a prop. The chargeman had visited t hem and examined the place both before and after the shot was fired. There was plenty of loose timber close at hand The Local Inspectors reported, ‘In our judgement it was a pure accident and could not be avoided.'
