- He was driving a pony taking rubbish into an old road from a repairer who was clearing a fall on a heading. In order to get there he had to change his pony from end to end of the tram. At the place of the accident he appears to have done so, there being room at one side, while on the other there was a broken arm within three inches of the tram, and as he had sprags in the wheels on this side, he seems to have been about to take them out, and had his hand on one when found. To do so he would cause the pony to pull up in order to ease the sprag. The pony probably backed a little, and his head was crushed between the tram and the broken arm About 4 yards further down there was room for the pony to pass at either side of the tram. The occurrence may be attributed to an error of judgement on the boy's part in changing at this point. He knew the district and had been driving the pony, a very quiet one, for some days.
