He, with two others, was going along a disused tram-road, which had been fenced off, when he tripped and falling sideways clear of the road went down headlong through the open gunniss to the 212 fathom level. It appeared to be doubtful whether the fence was actually in position across the disused tram-road on the day of the occurrence but it had been so previously, and this man and comrades were well aware that travelling along the road was forbidden.
