- Deceased was drawing timber in a waste to get some roof down to put in a pack. The rock was so hard that it usually required to be blasted. He had set a post to protect himself and was slackening or drawing another about 2 feet from it when a stone 4 feet 6 inches long 5 inches broad came away from a nearly vertical joint and caught him in the loins and legs. He died the same evening. The accident might have been prevented if deceased had complied with Special Rule 81. A sylvester was provided but it was lying at the foot of a jig 56 yards from him when the accident occurred.
