The accident happened at the face of a 5-yard bord. Deceased was kirving at the time, and he was killed by a fall of coal. He had undercut about 9 feet of face to a depth of 3 feet at one end, and tapering to nothing at the other; He had set no sprags. At the inquest, the jury added to their verdict that the accident might not have happened if the timbering rules had been properly observed.
