Deceased and another stoneman were taking down a top caunch in post stone at the junction of an ordinary gateway and a cross gateway in longwall workings in the Five Quarter seam about 3 miles from the shaft. They had almost finished their shift and were pinching down some stone when a stone 6 feet by 5.5 feet and varying in thickness from 3 inches to 10 inches fell from the roof and killed deceased. The stone was relieved by a jack and slip at right angles which were visible before it fell. It was supported by a prop and a plank, but considering the presence of the jack and slip some want of care was evident in not setting more timber under it a good supply of which was at hand. The master shifter had examined the place before work started but no official had visited it in the course of the shift. The Local Inspectors in their report stated ‘We certify in this report that it was a pure accident.'
