Deceased and his brother were lowering a tram containing four pieces of timber down a road dipping 2 inches per yard. They had no sprags in the wheels, and were both holding back in front of the tram. The brother slipped on an iron sleeper, and fell clear of the tram, which overpowered deceased and crushed him against a tram standing in the face of the dip.
