Several charges of gelignite had been placed under loose rock standing on a ledge 12 feet from the floor of the quarry, and failed to drop the stone. Two charges were then put under it, the intention being to fire both at the same time. Owing to an accident with the matches only one charge was fired, and when the deceased 15 minutes later, was lighting the fuse of the second charge, the stone rolled over and fatally injured him.
